Resumo

O 40º aniversário da Constituição Espanhola testemunha um contexto político e social que destaca as tensões secessionistas e eurocéticas que assolam os principais Estados da União Europeia. Atualmente, o movimento independentista catalão materializou essas tendências na Espanha, alegando razões injustificáveis. Este artigo analisa em detalhes como os fundamentos morais, políticos e jurídicos da identidade nacional espanhola e catalã estão enraizados na dignidade da condição humana e fornece a justificativa para uma reforma constitucional que manteria a Espanha, um Estado indivisível composto por uma nação de nações, na vanguarda mundial na organização das relações entre todos os seus cidadãos constituintes.

Joseph Weiler, New York University School of Law

oseph H.H. Weiler is professor at New York University School of Law and Senior Fellow at the Center for European Studies, Harvard. He works in the fields of comparative constitutional law, European integration, and international economic law as well as the relation ship between law and religion. His academic career spans prestigious institutions across Europe and the United States, including the European University Institute, where he served as President, and Harvard Law School. Professor Weiler's influential work encompasses numerous publications, notably "The Constitution of Europe" and "Un Europa Cristiana," reflecting his expertise in European Union law, international law, and the intersection of religion and law. His teaching at NYU focuses on critical areas such as WTO law, European Union law, and the legal aspects of globalization, emphasizing both professional skills and intellectual rigor in understanding complex national and international legal systems. In 2022 he was the first Jewish recipient to receive the Ratzinger Prize in Theology awarded by Pope Francis.
